Teslin Tlingit citizens are governed by Tlingit laws, that decisions that affect Teslin Tlingit citizen rights and entitlements are made by Tlingit decision makers, and that the enforcement of justice embraces a system that reflects Tlingit principles and values.
Administration of Justice

Since 1999, the Teslin Tlingit Council has been engaged in the negotiations and, currently, the implementation of an Administration of Justice Agreement (AJA) pursuant to section 13.6.0 of the Teslin Tlingit Council Self-Government Agreement.

The substantive sections of the AJA address the establishment of a Teslin Tlingit Council Peacemaker Court, its jurisdiction and authorities, appeals to and from the Peacemaker Court, law enforcement, corrections and community services, the implementation of the AJA and transitional measures.

Pre and Post-Charge Diversion Protocol
In 2002, the Teslin Tlingit Council completed the negotiations of a Pre and Post-Charge Diversion Protocol (Protocol) with Justice Canada, Yukon and the RCMP. More recent efforts have focused on drafting the Protocol and Peacemaker Procedures. The Protocol provides for adult or youth criminal matters (restricted to particular types of offences) to be diverted and heard before the

Teslin Tlingit Council Peacemakers. Under this process, the Crown (federal or territorial), or the RCMP, will refer these matters to the Teslin Tlingit Council Justice Coordinator. This person will take these matters to the five Clans who, in turn, will determine whether or not these matters will be brought before the Teslin Tlingit Council Peacemakers. To date, the Teslin Tlingit Council has trained ten Peacemakers in a wide range of skills to develop the community’s capacity to resolve conflicts and address justice related matters.

Charter of the Teslin Tlingit Nation

As the Teslin Tlingit Council continues to work in its various areas of authority and jurisdiction, Ha Kus Teyea (“Our Way”) was developed as the Tlingit Charter to provide a foundation and guidance to the legislative decision makers to ensure that Tlingit laws be premised on Tlingit values, principles and customs. Ha Kus Teyea was approved by Teslin Tlingit Council Genera Council in August 2004.

Peacemaker Court and Corrections Acts
In preparation for the implementation of the Administration of Justice Agreement (AJA), specifically the Peacemaker Court and Corrections sections, Teslin Tlingit Council Justice is working to complete two pieces of legislation: the Peacemaker Court Act and the Corrections Act. The legislation will be based on Tlingit values and principles and ensure the proper implementation and exercise of authority outlined in the AJA.
